A. Resolution Authorizing Town Manager, Matthew B. Galligan to Execute and Deliver any and all Documents deemed to be Necessary or Appropriate to the State of Connecticut, Department of Emergency Management and Homeland Security on behalf of the Town of South Windsor
Mirek, Delnicki Galligna - we belong to a regional grant endeavors - we do as a regional in rder to get more funds. We do this on a regional approach - This allows us to stay in the program. we have people that sit. we need resolution to continue participation. Snyder - these are just to enter into grant requests Galligna - yes and once grant comes in group determines what items. Snyder - federal grants are being processed through Homeland security Galligan yes- Delnikci - do we know what items Galligan - they are working on these items right now. communiction is still issue. trying to get everyone in the same wave length. looking at our dashboard system. they are trying to have other towns purchase that using our technology. we have had a lot of input on these things. Wagner - really support the idea of doing things regionally. Memorandum of AGreement - Appendix A no items are listed. Galligna - have not gotten together as a gropu to decide. Anwar - I am part of the State Emergency response Commission - fo rth efederal grants - the grants are usually floated to the whole system. - The State does not know how to disperse. is there an agreement that can be developed Galligan - the grants go to the State - these resolution go back to the state so they know wer are a regional based - unanimous

C. Resolution Authorizing the Sale or Disposal of Surplus Equipment
Snyder, Delnicki, Havens - is there a market for used fuel cells? Galligna - apparently there is. people are interested and will rehab them. we need to put out to a public sale becasue over requirement. Havens - does it have to be dismantled? Galligna - they woudl hav eto dismantle it themselves. Yagaloff - concerned about environmental issues. Anwar - school has been serving as shelter - we are in the process of acquiring generators Galligan - we have the community center for a shelter - need larger generator for HS - we also have Wapping School for emergencies Anwar - we have plan until we get larger generator for high school (as said will use Wapping and Community Center) unanimous

Wagner - Delnicki Galligan - Jay is here and he is our part time person for Emergency Management. Jay - Emergency Management Performance Grant. Essentially 12,000 - we can do what we want as long as it falls in the category of emergency management. Requested items that departments needed for emergency management - a list has been compiled. Yagaloff - tells u about our EOC - Jay - located right now - we need to build an EOC - we have a training room right now. we support the incident that is going on outside. Anything that is aboe and beyond that we normally take care of. Large scale emergencies, opening shelter, out of power for one week. Yagaloff - room that is being used, is it s large enouigh to accommodate outside resources that would also come in to assist? Jay - yes and no - we look to beyond that - review policies and procedures - when different departments are coinmg in ned a much larger area. EOC should be about 3500 to 5000 and we have a 20 x 20 room. Yagaloff - the equipment that supports an emergency response, things that would be shared among responders. we don't have storage area Galligna - we are trying to create a CERC team. Yagaloff - one of the things the council is looking at is volunteers. Is one of your jobs putting togther recommendations for the EOC Galligan - used by us but shared with other towns. Yagaloff - it would be great to have an EOC in SW but to have other communities to be a part of that. would you be able to put together plan for emergency operations center needs. Jay - yes I coudl put something together - why we need EOC and why use the old post office. Galligan - I would agree - he has already contacted the State. this side of the River there are things lacking but on the other side of the river they do have items. Yagaloff - responses to events at schools or malls. I think we really need this facility. important to focus on this. Jay - the State o fCT through Deputy Commission Shay and _________ are putting together program - would like council members look at other EOC's - would like a workshop - Anwar - you have volunteered a lot of your time. Prague, Wagner Galligan - TA feels we should have lease that allows us to bid off of the State contract - TA does not feel what the towns has done in the past is not legal - come up with an ordinance that will allow us to make purchaes under state bids, etc. An ordinance will be drafted in the future. Snyder - our charter says Galligna - anything over 5,000 has to go to bid Snyder - you entered into agreement with Tip gALLIGAN - The Town Attorney after reviewing the lease he felt there was nothing in an ordinance - can't go to State to use their bid. Need to create an ordinance to do cooperative purchasing. Snyder - under CGS Towns can't Olson - your charter says you must go out to bid. problem is the Town ATtorney was asked for legal opinion. Snyder - in lieu of state bidding ---- Kari - we were already going to draft ordinance - Delnicki - the charter is clear unless we take special exception we have to bid things out. yet we can do an ordinance to get around the requiremetns of the charter. Kari - the state has provided legislation to have "not withstanding their Galligan - Kari Dlenicki - we are meeting the test of the charter - creating an ordinance that has not been tested in teh court of law as to whether an ordiannce can do what the charter --- - it has not been tested unless someone does test it. Kari - there is a well reasons legal opinoin to do what is being requested. - in htis instance would want to waiver with CCM. Yagaloff - I understand the reason for doing this., caution that we have always talked about local peopel being able to bid. if we go strictly to the State and the lcoal people do no tknow items are being bid out. I do't know where this company is located. Galligan - we ususally would put out to bid. when we did no one responsded. Yagaloff - this went out to bid Galligna - went out to get qauotes Yagloff - will support but policy we are going to sort of make policy - do ordinance to allow us to State website and that ould afford small businesses of completing with State. that may make it tough for small buisnesses. could have impacts on local busineses. Mirek - is it possible to change the charter to 10,000 Prague - we have 169 TA and going to get different opinions for each. I would open up the charter, businesses have to learn to compete. Snyder - I think the most imporatnat thing sis the ordinance wil allow us to use a state contrct - just because you can does not always mean you should. you are spending taxpayers money and you have to be competitive. anyting tht allows Town MKanager or Town to use State wh spend money to put out a bid when you can use the state contract. having flexibility - I agree with this. I like the flexibility for the Town Manager and his staff. Galligan - it is getting tough out there. As a Town maanger I have the responsibility of getting the best price for the town. we try to get local works the buisnesses when we can Prague - what is the value of this contract? Galligan - 15,000 Anwar - there is value in this conversation - if we move in this direction there is risk of slippery slope - I agree with comments of flexibility. we want ot make sure local businesses have an opportunity. i would support htis resoluiton. going foward it will be a little bit more complext having ordiannce. I htink case by case basis would be better. Wagner - weighing the value of giving buisnesses to local buisness - the town also benefits on haveing that local buisness being successful. Galligna - low responsible bidder. Delnicki - Kari - we wre asked to give an opinion - there has been a large savings to the town. Yagaloff - not every local busines is bidding for state bids. we become more globalized. not all buisneses have the ability to compete on New England basis or US basis. Not all small businesses have the capacity to compete on STate level. Kari - some towns have gone to less formal proposals Anwar - as we move forward with the strategic plan we can look at items for the charter. unanimous

Pendleton, Delnicki Yagaloff - in past the town decides on the purchase price. Is this a property that we have discussed the purchase price Galligan - still negotiations are still going on. Yagaloff - price perimeters - not going to make final purchase until it comes back to the Council Galligna - correct Yagaloff - Council has already given approval Galligna - we are trying to start a better procedure. Kari - if th ebond money is being used - this is one of the properties that will have to use the ordinance to be amended. unanimous.

Yagaloff - we table the abatement resoluiton but have a question - on abatemetns that go through EDC there is a process for small businesses - we usually get financials that justify the tax abatement. Galligan - they wre going to come and state why - they are willing to pay building fees - care taxes - bid comes down to financial thing - I did not get the message until today that they were looking to hold off. Yagaloff - if they choose to do - whether the town want to give them tax abatement. counicl is looking for tax agreement lowering rent Galligna - rents are not market driven. will talk to the developer Havens - it may be the only reason you are considering to move into the community. Galligan - more residential renting is necessary in SW Havens - Evergreen is to survive and grow - this would be a way to do it. Galligan - if you look at any of th eLifestyle areas that is how is happends. Mirek - School Security issues - historically in SW we have had our polling places in schools. the schools in sw are closed on election day - however during referendums and primaries schols are open. woul dlike to hav ecommittee including registara, chair town council and tm to see what we can do to move voting sout of the schools. feel very antsy. Proposing that we revisit it.
