Robert Dickinson, 19 Birch Road - traveling down Sullivan Avenue have seen people walking or biking which is pretty dangerous. We should do something to improve the safety of that situation and the way people are dressed they are probably going to work. Could contact employers to encourage them to wear reflector vest. Sidewalks could be a solution but can not do that right away. There
Garfield, 1021 Ellington Road - I am a parent of three children in South WIndsor schools. I am here to express my support for the elementary school plan. plan offers the Town certain needs. Even though my kids will be out of the elementary school ther will still be a benefit.
Shari F - 601 Dzen Way - gave the council a summary of what has happened with economic development.
Barbara Hoff, 51 Wildlife Trail, came forward to speak in favor of referendum Elementary School plan. Hope that Town Council will support.
Maura, 177 Homestead Drive, support of referendum. in 25 year TE has been remodeled as well as the High School. The elementary schools have had little change. if we allow elementary schools to age the problems are going to get worse. My children will not benefit from the plan but would like better elementary school system. Urge the Town Council to support the referendum.
Carl Werkhoven - best friend died 4 weeks ago. - here again in regards to the driving - simple sign says "Safety First No Cell Phone While Driving". I was looking for help from everyone here. I want to get going on this. Everyone on the Council has the ability to help. I want to continue this fight because it is a concern of mine that needs attention.
Mary Etter, Director of the SW Public Library and SW Human Relations Commission - WE anticipate another season - 7p.m. 2/20 Opening Doors to Understanding. Each of the programs will focus on diverse groups. Start with Hindu on Thursday. There will be additional programs in March and April.

Pendleton - to support firefighters - there is money in the budget for snow removal around the fire hydrants. Saves time for fire fighters. Mirek - coyote attacks on dogs. if they go out with their dog please stay with your dog. Be on the altert. Anwar - with the amount of snow we have had there are visibility challenges. Be aware of children standing on the roadside.

9. Communications from Officers and Boards Directly Responsible to Council
Wagner - Pension Committee met earlier this month - what happened is the Pension with the BOE and Town - pensions have been funded under the assumption that we would get 8% return. The pension Committee decided to change the discount rate to 7.5%. It will require the town to spend more in the short term but will prevent large expense to the taxpayers when these pensions come due. we reviewed the pensions and where money is being held.
Snyder - Capital Projects - we are currently working on completeing the information sheets - project sheets. There are definitions of each project and the details for each project. Our intent is to look at those tomorrow night and start to sort through that.

Snyder, Wagner Wagner - my understanding is the standard minimum is 12 to 8 - propose friendly amendment to pen 6-8 Snyder - I am not sure that iw being discussed at this time. We are just calling for the date. accept 6am to 8pm. Yagaloff - this project has been - supporting. Delnicki - this has been an effort for years. I think this plan before us and the approach is the most reasonable approach that I have seen. I truly believe this has the best ability to get passed, supporting it. Wagner - strongly endorse the proposed plan and hope voters will see how important for the entire town. very impressed with work done to put the plan together. I strong endorse and hope voters will support. Mirek - endorse plan and hope everyone in the community endorses the plan. between the state reimbursements and the debt being paid down there will be minimal impact to taxpayers. Prague - thanked the BOE and Superintendnet for brinigng this plan forward. support and hope gets approved. Snyder - plan makes sense and it is the right time. moving forward with plan - there was a plan a long time ago, the High school done first, TE and now the elementary schools. urge if anyone interested in seeing the plan go to BOE website and there is information about the plan. March 15 please go vote. Pendleton - thanked the BOE for their hard work and Dr. Carter. encourage voters to come out and vote for this plan. Anwar - this is very well thorught out. required people to work together. financally makes sense and strategically makes sense. time for us to do waht is right for the next many children who will go there. I also thank everyone who has put numerous hours into this plan and it takes care of multiple community needs. encourage people to vote. unanimous

Snyder, Delnicki Pendleton - with what Councilor Snyder said - shoudl relect the correct number Attorney M - it could be - my understanding is the second number is the most important. Pendleotn - reflect the actual dollar amounts 33,520 to 33,521,724 (FRIENDLY AMENDMENT) Yagaloff - the first vote was setting the date, now this is the vote to approve the spending of the money conditioned that referendum passes. since we have the money in there - the amount of money being reimbursed is not reflected in this resolution. The residents need to know about the reimbursement. The next vote will be providing for referendum and the next vote for explanatory text. Anwar - remind everyone in nine minutes will have public hearing. Snyder - thank you Councilor Yagaloff - the 34.64% reimbursement rate. -for new school construction. There is a different percentage for rehabilitation. not everything is reimbursable. The actual cost to taxpayers is the 22,258,----. suggest amending Exhibit B as well - Snyder would also take as friendly amendment - Pendleton made unanimous

Mirek, Delnicki Gantick - at the end of tonight less then 300 tons of salt. have not delivered in two weeks. 1-2 storms left. this is critical. Delnicki - commend your guys. 1 27 treatable events - 14 snow events. Delnicki - cost of dealing what we have going on here. we want to keep streets safe. have we been able to go strictly with salt. Gantick - if we want to just use salt but have to use sand it need be. Delnicki - Governor reaching out to towns in connecticut - is there any advantage to take govenrors offer. Gantick - the offer was for last weekend. it was for towns with no salt left. Delnicki - where are we on overtime Gantick - way over. we have not had a chance to calculate it - we were in the red as of last week. Delnicki - council needs to support overtime in this situatin to keep the streets safe. should look at number for overtime so we are prepared for it. Guys ar edoin ga great job. Yagaloff - incredible work done on the roads. If we had to buy for 300.00 a ton - the fact that people can travel the roads after a storm safely is incredible and takes a lot of work. thank you. Gantick - yes we have six Prague - what does salt shed hold Gantick - 4,000 tons Prgue ow mahy left Gantick - less then 300 tons Prgue - have we been paying 74.68 for treat salt Gantick - yes per ton. Prague - what does average storm use? Gantick - we have been leaders in the State of CT to weigh salt. we have trained a number of communities 95, 280 tons per storm. Wagner - compliment your staff and contractors. noticed expenses as of 1/31 - Gatnick - Parks has over time as well Wagner - looks like we are oging to blow through PW budget before the end of the fiscal year. we will need to figure that out. Galligan - will look for ways to readjust the budgets. I have contacted some companies with untreated salt - we are on top of situation. Pendleton - is there a better tiem of year to purchase salt? Gantick - fixed price no matter when you go out. we had plan for salt reserves. our goal is to keep that salt shed full. we need to be prepared. this is not something to fool around with. Pendleton - would like to prepare for next year - some how in the future let us get it restocked so we are not in this predicament next year. Have heard Manchester is better - Gantick - we try to balance - we are trying to balance - side lines - we will be knocking some of those down. Anwar - if we were in posiiton to put sand couldn't we ask the State Gantick - ther are a lot of other issues going on. Anwar - so sand is the last resort - some of the town buildings do the roofs need to be cleared? Gantick - trying ot keep drains cleared. we are looking at that Anwar - next meeting would like status of extra costs. PW has made sure branches have been cut with CL & P. investments are paying off. our town efficiency for using salt is wonderful. Prague - there was 56 inches of snow - 25 now, with rain coming all bets are off. Delnicki - have had conversations with Pat Hankard - take sample and weigh it unanimous

Delnicki, Anwar Galligan - rescue truck went down - budget did not have enough - decided to get rebuilt and wiped out their budget. Chief Cooney - have sent emails - Delnicki - the piece of aparatus will that increase the vehicle. Chief - with repair there is a five year warranty. initial replacemtn was 2019. modifications have also been made to truck. Delnicki - have fire aparatus mechanic. very unusal - could not give us reason why this happened. Delnicki -right decision to put new engine into especially when life of vehicle has been lengthened. Anwar - thank you for explanation - supprt unanimous.
Prague - Snyder Prague - Everbridge originally we had three year freebie and now time ot pay. Yagaloff - Councilor Pendleton and I are doing CERC training. Everbridge is used by First Responders. I am really happy we implemented Everbridge. Galligan - when we started this it was for emergency situations. we train department heads how to use it. very good system. unanmous

M. Resolution Waiving the Competitive Bidding and RFP Process for Engineering Design and Construction Services for two Underground Fuel Oil Storage Tank Replacements at the Police Department
Yagaloff - Snyder Yagaloff - this is the second time proposing going to - was not happy to bypass local bidders. there are local providers that do not go through the state. Fuss and O"Neil would design and then subcontrct out. Galligna - they do not do tank removal. Timing is an issue. Clay - there are local people tht do it and the State contract has component for it. All of ht ecomponents are there - they are gong to use local contractors. Yagaloff - do they have to go out for RFP Clay - they solicit three and then choose. Yagaloff - it is the concept of us going to State and not going for RFP Clay - Yagaloff - concerned about local busines that can do the work but they can not do it at the State level. We lose control over the State process. Maybe a phone bid could be done but htis is not the case here. Galligna - phone bids can not do - they have to be sealed bids. Trying to keep the costs down. Yagaloff - we were going to have a policy discussion on this issue and never did. I want ot get this done becasue oil tanks need to be complete but on the other hand not using local will hurt local people. Galligna - some of these items -In the budget this year need to put projects in the budget. Yagaloff - I think I am going to vote against only because of the my feelings regarding DAS process over our local. need to have a plicy discusion. Delnicki - are there any local busineses that coulddo that work? Clay - I think there are two. Delnicki - are we going to use local business like that? If there are qualified local person should use. are we going with above ground? yes Pendleton -why are we receiving htis so close to August? Galligan - funding Pendleton - support project but do not support the process. I support local bids and opening up to companies that would choose to do this. I am not quite sure on how will vote on tis. Snyder - this is not new. when Department of Administrative SErvices like a bid - they meet all of the state requirements for bidding. it is reaching the entire state. South WIndsor local businesses can and do respond. The bid process if being done. The process has already been done by the State and cover the costs. I support and do not know why we don't use the State more often. Willl not get project done if the town does on their own. Support this. Galligan - we used to use this process all of the time - legal opinion was told the charter says no. my concern is prices will go up. Wagner - no way local bidding porcess Galligna - bidding porcess if open to everyone, not just local. Wagner - isn't there a not withstanding the local charter Mike - there is a state law that allows Town Council the abiluty to bypass. Prague - I think we had four referendums and I think this one did not pass and I was very disappointed. Mirek - it is very easy to get these bids. People from SW can compete and win a bid with the State. I support Yagaloff - we may be losing sight of the actual process. we are saying the town wants to select one person off of the State contract list - the town is gong to bypass those others and pick person off of the list. that allows for anybody who has the right to select a bid - concern - large companies are going to take business away from local contractors. Clay - penalty for being late is 25,000. not asking to waive on all projects. we wwant ot make sure the job gets done in timely manner. Yagaloff - I think it is a very important project just council has previously discussed this process. Tonight is going to be a policy vote tonight that we shoudl give local contractors Galligan - do not have a problem with policy. still run risk if tonw goes out to bid. these projects should be done sooner. Anwar - I will support this. we do not give resources to the town on time and we have an environmental responsibility. we are in a bind and have to d what we have to do. need to look at on a case by case basis. will support. at some point need to have discussion on this type of issute. Delnicki - will support - there is local buisness on that list and sure have every hope that SW business gets the job. 6-2 passed
N. Resolution Endorsing the Regional Performance Incentive Program Project Proposal and Authorizing Town Manager, Matthew B. Galligan to Sign All Necessary Agreements
Prague, Delnicki Galligna - these are CRCOG grants. Data Recovery - we have data recovery on our system - if all towns participate may be able to keep costs donw. the second one - we started the portal system with ADP - we have employees who go inot the system and change benefits, etc. CRCOG looked at this - our costs have gone down. O. Resolution Setting a Time & Place for a Public Hearing to Receive Citizen Input on a Proposed Ordinance Referring all Recreational Related Proposals to the Park & Recreation Commission
Mirek, Delnicki Mirek - wondering if it is an ordinance that we need or a policy. Wagner - there have been time sint he past where the Commission feels they have been bypassed. the idea here is we would give them an opportunity before Council took such option. Andy Paterna - our issue is the idea of how can we get the best information to the Council. Snyder - the idea of the Rec Center was something that came up because of another discussion. I don't know if we need an ordinance or a law to make sure everything is vetted through Recreation. A policy should be estalblished. Concerned with putting another ordinance on the books. Way over regulating us. Yagaloff - I was worried too. I read the ordinance and do not see anything regulating the Council. It says at the end of the day we have a Park & Recreation who can look at a policy and the Council needs to wait for a recommendation from Park & Rec. It doesn't bind the Council. can clear up confusion. - will be in support Delnicki - this is if we are going to go to public hearing and seek public input. will support Mirek - what happened on how the recreation dept was not involved. Andy - never came to Park & Recreation for formal endorsement. Prague - do you support this ordinance? Anydy - yes Prague - Mr. Zimmerman do you support his oridnance? Craign Zimmerman - reason for the oridnance was the hockey rink. There is already a policy but that does not get followed. Crafted very well. unanimous
P. Resolution Continuing the Water Pollution Control Taskforce and Directing the Town to Implement an Enterprise Fund Management System for Sewer Expenses
Wagner, Pendleton Mirek - Enterprise fund - do they collect or set up with the town Galligan - probably hire individuasl to do that but - the whole idea of enterprise fund is everything willb e shown together. Need good reporting system Mirek - does the WPCA Committee ok with this? Galligan - we had a meeting recently. The committee feels the enterprise system should be looked at. reporting requirement key. there are members that are open to this and some that are not. up to WPCA if they want to adopt. Wagner - it is very difficult for someone to look at the financials and understand what is happening and hard to manage. Snyder - same group that was same community people. Snyder - I understnad the Mr. Aries provided letter ot the Mayor. Delnicki - this is continuation of work - we did not have sunset date on that committee. this just explaing function of this committee. Enterprise fund will provdie transparency. Yagaloff - the new excitement is the enterprise fund. wanted to find out different information and system needs to be established. Q. Resolution to Support Regional Cooperation Among Adjoining Towns
Anwar, Delnicki Prague - why is this needed, don't we already do that? Anwar - we have been but we needs more support from the Town Council. Prague - can we really save money for our taxpayers? Galligna - if you look at the Rgional Animal Colntrol Center - we savesed there. Can save money doing things reginally. Can now show I have support of our Council. Snyder - do you need to have this to make you do what you have done for the past 20 years? Galligan - nice to have that support. Not necessary but good to have in your pocket. Snyder - you want something like this. Galligan - I have no problem with this. Yagaloff - we have talked about doing a regional EOC. Galligna - have to lower costs and give better services. Delnicki - voluntary not mandatory. AMend - put in 3rd paragraph voluntary, Mayor Anwar accepted the friendly amendment. Pendleton - believe in voluntary - What is our region? CRCOG 29 Towns working with Tolland and Voentry has been a money maker. Delnicki - unanimous

The elementary schools have had little change. if we allow elementary schools to age the problems are going to get worse. My children will not benefit from the plan but would like better elementary school system. Urge the Town Council to support the referendum.

Wagner - Pension Committee met earlier this month - what happened is the Pension with the BOE and Town - pensions have been funded under the assumption that we would get 8% return. The pension Committee decided to change the discount rate to 7.5%. It will require the town to spend more in the short term but will prevent large expense to the taxpayers when these pensions come due. we reviewed the pensions and where money is being held.
Snyder - Capital Projects - we are currently working on completeing the information sheets - project sheets. There are definitions of each project and the details for each project. Our intent is to look at those tomorrow night and start to sort through that.

We are just calling for the date. accept 6am to 8pm. Yagaloff - this project has been - supporting. Delnicki - this has been an effort for years. I think this plan before us and the approach is the most reasonable approach that I have seen. I truly believe this has the best ability to get passed, supporting it. Wagner - strongly endorse the proposed plan and hope voters will see how important for the entire town. very impressed with work done to put the plan together. I strong endorse and hope voters will support. Mirek - endorse plan and hope everyone in the community endorses the plan. between the state reimbursements and the debt being paid down there will be minimal impact to taxpayers. Prague - thanked the BOE and Superintendnet for brinigng this plan forward. support and hope gets approved. Snyder - plan makes sense and it is the right time. moving forward with plan - there was a plan a long time ago, the High school done first, TE and now the elementary schools. urge if anyone interested in seeing the plan go to BOE website and there is information about the plan. March 15 please go vote. Pendleton - thanked the BOE for their hard work and Dr. Carter. encourage voters to come out and vote for this plan. Pendleotn - reflect the actual dollar amounts 33,520 to 33,521,724 (FRIENDLY AMENDMENT) Yagaloff - the first vote was setting the date, now this is the vote to approve the spending of the money conditioned that referendum passes. since we have the money in there - the amount of money being reimbursed is not reflected in this resolution. The residents need to know about the reimbursement. The next vote will be providing for referendum and the next vote for explanatory text. Gantick - if we want to just use salt but have to use sand it need be. Delnicki - Governor reaching out to towns in connecticut - is there any advantage to take govenrors offer. Gantick - the offer was for last weekend. it was for towns with no salt left. Delnicki - where are we on overtime Gantick - way over. we have not had a chance to calculate it - we were in the red as of last week. Delnicki, Anwar Galligan - rescue truck went down - budget did not have enough - decided to get rebuilt and wiped out their budget. Chief Cooney - have sent emails - Delnicki - the piece of aparatus will that increase the vehicle. Chief - with repair there is a five year warranty. initial replacemtn was 2019. modifications have also been made to truck. Delnicki - have fire aparatus mechanic. very unusal - could not give us reason why this happened. Delnicki -right decision to put new engine into especially when life of vehicle has been lengthened. Yagaloff - Snyder Yagaloff - this is the second time proposing going to - was not happy to bypass local bidders. there are local providers that do not go through the state. Fuss and O"Neil would design and then subcontrct out. Galligna - they do not do tank removal. Timing is an issue. Clay - there are local people tht do it and the State contract has component for it. All of ht ecomponents are there - they are gong to use local contractors. Yagaloff - do they have to go out for RFP Clay - they solicit three and then choose. Yagaloff - it is the concept of us going to State and not going for RFP Clay - Yagaloff - concerned about local busines that can do the work but they can not do it at the State level. We lose control over the State process. Maybe a phone bid could be done but htis is not the case here. Galligna - phone bids can not do - they have to be sealed bids. Trying to keep the costs down. Yagaloff - we were going to have a policy discussion on this issue and never did. I want ot get this done becasue oil tanks need to be complete but on the other hand not using local will hurt local people. Galligna - some of these items -In the budget this year need to put projects in the budget. Yagaloff - I think I am going to vote against only because of the my feelings regarding DAS process over our local. need to have a plicy discusion. Delnicki - are there any local busineses that coulddo that work? Clay - I think there are two. Delnicki - are we going to use local business like that? If there are qualified local person should use. are we going with above ground? yes Pendleton -why are we receiving htis so close to August? Galligan - funding Pendleton - support project but do not support the process. I support local bids and opening up to companies that would choose to do this. I am not quite sure on how will vote on tis. Snyder - this is not new. when Department of Administrative SErvices like a bid - they meet all of the state requirements for bidding. it is reaching the entire state. South WIndsor local businesses can and do respond. The bid process if being done. The process has already been done by the State and cover the costs. I support and do not know why we don't use the State more often. Willl not get project done if the town does on their own. Support this. Galligan - we used to use this process all of the time - legal opinion was told the charter says no. my concern is prices will go up. Wagner - no way local bidding porcess Galligna - bidding porcess if open to everyone, not just local. Wagner - isn't there a not withstanding the local charter Mike - there is a state law that allows Town Council the abiluty to bypass. Prague - I think we had four referendums and I think this one did not pass and I was very disappointed. Mirek - it is very easy to get these bids. People from SW can compete and win a bid with the State. I support Yagaloff - we may be losing sight of the actual process. we are saying the town wants to select one person off of the State contract list - the town is gong to bypass those others and pick person off of the list. that allows for anybody who has the right to select a bid - concern - large companies are going to take business away from local contractors. Clay - penalty for being late is 25,000. not asking to waive on all projects. we wwant ot make sure the job gets done in timely manner. Yagaloff - I think it is a very important project just council has previously discussed this process. Tonight is going to be a policy vote tonight that we shoudl give local contractors Galligan - do not have a problem with policy. still run risk if tonw goes out to bid. these projects should be done sooner. Anwar - I will support this. we do not give resources to the town on time and we have an environmental responsibility. we are in a bind and have to d what we have to do. need to look at on a case by case basis. will support. at some point need to have discussion on this type of issute. Delnicki - will support - there is local buisness on that list and sure have every hope that SW business gets the job. 6-2 passed

Mirek, Delnicki Mirek - wondering if it is an ordinance that we need or a policy. Wagner - there have been time sint he past where the Commission feels they have been bypassed. the idea here is we would give them an opportunity before Council took such option. Andy Paterna - our issue is the idea of how can we get the best information to the Council. Snyder - the idea of the Rec Center was something that came up because of another discussion. I don't know if we need an ordinance or a law to make sure everything is vetted through Recreation. A policy should be estalblished. Concerned with putting another ordinance on the books. Way over regulating us. Yagaloff - I was worried too. I read the ordinance and do not see anything regulating the Council. It says at the end of the day we have a Park & Recreation who can look at a policy and the Council needs to wait for a recommendation from Park & Rec. It doesn't bind the Council. can clear up confusion. - will be in support Delnicki - this is if we are going to go to public hearing and seek public input. will support Mirek - what happened on how the recreation dept was not involved. Andy - never came to Park & Recreation for formal endorsement. Prague - do you support this ordinance? Anydy - yes Prague - Mr. Zimmerman do you support his oridnance? Craign Zimmerman - reason for the oridnance was the hockey rink. There is already a policy but that does not get followed. Crafted very well. unanimous

Wagner, Pendleton Mirek - Enterprise fund - do they collect or set up with the town Galligan - probably hire individuasl to do that but - the whole idea of enterprise fund is everything willb e shown together. Need good reporting system Mirek - does the WPCA Committee ok with this? Galligan - we had a meeting recently. The committee feels the enterprise system should be looked at. reporting requirement key. there are members that are open to this and some that are not. up to WPCA if they want to adopt. Wagner - it is very difficult for someone to look at the financials and understand what is happening and hard to manage. Snyder - same group that was same community people. Snyder - I understnad the Mr. Aries provided letter ot the Mayor. Delnicki - this is continuation of work - we did not have sunset date on that committee. this just explaing function of this committee. Enterprise fund will provdie transparency. Yagaloff - the new excitement is the enterprise fund. wanted to find out different information and system needs to be established. Anwar, Delnicki Prague - why is this needed, don't we already do that? Anwar - we have been but we needs more support from the Town Council. Prague - can we really save money for our taxpayers? Galligna - if you look at the Rgional Animal Colntrol Center - we savesed there. Can save money doing things reginally. Can now show I have support of our Council. Snyder - do you need to have this to make you do what you have done for the past 20 years? Galligan - nice to have that support. Not necessary but good to have in your pocket. Snyder - you want something like this. Galligan - I have no problem with this. Yagaloff - we have talked about doing a regional EOC. Galligna - have to lower costs and give better services.
