Ray Favreau - coming trends that will impact public parks are drones. Partner with ------- along with Federal Administration and ------- to study this new program. There are strict but reasonable flying regulations. We feel this trend will stay and may need policies, procedures and guidelines. public education may also be necessary. We have to review everything. Just wanted to give the Tow Council a heads up. The pool opens up 23rd for the Memorial Day weekend. Will be open until 12:00 on Monday. Our primary purpose is for a safe and enjoyable pool fund. June 21st we have limited hours when school is in session. then UAF drones Councilor Mirek - had an episode this weekend. when the ashes they feel were cold - embers can stay active for five days. extremely dry and be careful of cigarettes. be careful with grills, should keep away from siding and deck.

Andy Paterna - Liaison for SW Historical Society - Brian Rivard reported has received grant - the Wagner - council supported changing street lights to LED Streetlights. just under 4 million dollar savings. our 10 years savings with program 1.2M, I did talk to an executive from United Illuminated - the savings over 20 years 4-5M range even though generation rate went down. Mirek - 10 years 1.2M - 20 Wagner - will actually be 3.9M for 10 years - these numbers are best knowledge

Galligna - Review his Town Manager's Report - Turf field, Police Department Cell Tower, Microbrewery, - gave DOT traffic counts and feelt here is not enough traffic eto warrant a light there. Local company should not have to spend that type of money that DOT is responsible for. Showed DOT that there used to be a house there with a drivewya - would have access off of the driveway - had a great meeting with DOT. They do not hav ea problem with that, site difference is ok. parking behind the building - change driveway - Think that is the way we are going to go. P & Z has to do a review. Hopefully we can get microbrewery up and running. Think we worked that out an dhpe we can move forward Sullivan Avenue House - talked with Scannel Properties about coming up with the money - They are discusssing htis right now - Wayne Gerlt wil be informing me if this is a direction that they would like to go. Would like the Council's input on this project. Nevers Road Field - would like the Council's input on this issue. Avery heights Gas Service - Dzen Tree Farm Energy Commmittee - Riley - Meeting with the residents regarding the turf field. I think we heard them as a Council. The fact that we have not pt lights in there would be a negative impact on the amount of time the field could be used. would like to use non-toxic fill, address concerns with barriers. mvoing bleachers, trash are items that are easily accomplished as well as the use of the loud speaker. Is there a policy or practice regarding use by Youth Sports using BOE fields. Galligna - right now we don't have any policies. Would like to discuss with Superintendent to see if they have any policies or practice Ray - there are not policies at this time - we encourage no use before 11 - All of the fields at our schools they are relatively close to neighborhoods. Policy should govern all of BOE properties. We are not putting lights at the high school - the idea of eliminating use of field on Sundays would be a detriment and would not support. Paterna - do we have a confirmation that the bleachers will be moved. Galligna - will have my staff move those. Paterna - if you look at all of our facilities, no other school has fields tht close to neighborhoods. should show good faith effort that the neighbors concerns are met. should not discuss uses yet. Mirek - there could be an issue if we limit playing time there and not at other facilities. Should add field at Nevers so they can be used as practice fields. tht will give us higher quality fields. Avery Heights Gas Service - is there a time line established. Don't want the new pavement dug up Galligna - shoudl get small committee together. we can not get involved. if they are interested - we will coordinate with the companies. the problem is that it is nice ot have but there are costs assocaited with this. Up to the residents Mirek - in my neighborhood did it and - there was no chasrge. is there a way neighbors could be infomred Galligan - there is rep from Gas Company - they will come out and do promotions. Wagner - I would encourage you to go forward with teh cell tower. Sullivan House - I have never been inside, is it big enought for activities? Galigan - does not need to be massive - volunteers and other civic groups could use. Wagner - Chamber could fit in there and there could still be room for others? Galligna - yes and talked about refurbishing the garage. Delnicki - recollection when firs tput tower at PD - I think we dedicated most of the funds to the Police Department and Fire Department? Galligan - yes - renovation to communications. Delnici - it would make sense to follow tht same? Galligna - up to the Council. Delnicki - clarify, we are on the CCM contract fo renergy purchasing, is that all locations or actively metered? Galligan - locations of ______Transcanada Delnicki - does that change when we take ownership of the lights? Galligna - can get you that information Delnicki - if less than Transcanada - Galligna - LED has lower costs Delnicki - could have significan savings with Transcanada Wagner - right now this rate that Eversource has given it is slightly lower than Transcanada. Delnicki - thank you - Is Transcanada going to change rate to stay competitive. Galligan - can bring that up. Delnicki - we should find out if other CCM members have done this way - Transcanada needs to stay competitive. Havens - recommendations are very good. the historic nature of the Clat House. Silo and Clat HOuse have to stay. Lets save the Clat House. Pendleton - thanks for the excellent report. appreciate town meeting with the neighbors near the high school. Better drainage which woudl be more of a financial savings. could use that to help the neighbors. No other school fields touch a neighborhood. there should be no Sunday play at th ehigh school. Will the tower have an effect if we went regional 911? Galligna - regionalization is Sharkey and Senator Lunney. It has nothing to do with SW. Anwar - Turf Field - we can divide into three categories, 1) 2) legality and 3) structural component - once sound barrier is good maybe the neighbors would be more receptive to Sunday play. Need to work closely with BOE. Cell Tower - $400,000 per year? Galligna - no one time cost. Anwar - if you recommend, I fully support. Microbrewery - moving in the right direction Sullivan Avenue House - would like to protect that asset. presently in working condition. would like to come up with strategy and partnerships. would b ea good way to preserve and create mechanism that hte taxpayers would not have to pay for it. You have my full support. important to preserve house (Welcome Center). Galligan - you may lose money on federal grants - house is old Anwar - Nevers Road field - neighbors have been vocal - glad that buisnesses are interested in supporting this. Barton property would provide much more and this should be discussed. Avery Heights - the reason part of the raods were ijmpacted was because of the - this is the time to put gas lines in. Energy Committee this proposal that Eversource has allows us to look at energy use of the town. The cost is free to the town. we have one of our schools tha twe want an energy audit of. the June 1st timeline is close - I was going to supest that we should add an agenda item to apply for the grant. If we coule add it would give us more time. This will benefit the town. Mirek - clarify that the Nevers Road field are separate from the Barton property. Kids at the High School would not be able to go to the Barton property. Riley - the original 11 acre project, how much did that property cost? Galligan - the whol Nevers Road was 3M - Riley - 11 acres we lease Galligna - yes we lease to a farmer. Riley - what do we get? Galligna - would have to look up - $1,000 or $1,500 Riley - I don't think the community is geting their bang for their buck. It is a prime location. The proposal that was put forth by the community is for using that property. I think it would be a perfect use. Good use for the community. Not right location to keep as a farm. Snyder - Looking for Council direction on Sullivan Avenue House and the Nevers Road field Galligan - also sale of cell tower Wagner - if we are going to take up Nevers Road field - would like review of legal basis when we bought this. People have come in and said that agricultural use not appropirate for that area. Galligna - will have TA review. Delnicki - eversource - TA look to see if we coudl get involved in any fashion, TM - etc. Where do we stand on this? Yagaloff - there is a 45 day appeal process - that is a decision the council has to make - 45 days from Siting Council. Time is runnin gout. If neighbors filed an appeal and they wanted the Town to participate - Galligan - the other thing I did meet with Marcia Wellman - told her the concerns. the are moving - ther eis not much from my standpoint - need to have better barriers. I drove p there and I know what the people are complaining about. I would like to have another meeting with the three neighbors that are directly affected. I can' do anything legally can only talk to them about public policy. we are going to try to have something done. they are moving some wires away from the houses. Delnikci - so it is work in progress and we are talking action. Delnicki - agree about the Clap House Paterna - Talked to some of the neighbors up there and through their hard work they are doing some things. they ar eputting sound pads under some towers bu tnot all. Right now the Siting Council ignors the towns - we need to find away to work together. Havens - Nevers Road property - went through that battles - the neighbors do not want ballfields there. The property where they live is absorbed with the Little League and nois ein the area - did not support then and do not support now. We don't want ot bring that problem back again. There are other areas. Anwar - direction on a few things. Police Department Cell Tower - $400,000 - have consensus on that. Sullivan Avenue House - protect and use with minimal taxpayers money - have consensus on that. Nevers Road Field - no consensus on this issue 3 yes 6 no

Wagner, Pendleton Delnicki - how long have? Galligna - 5th year will have to do RFP Delnikci - when Galligna - could do that now. Delnicki - new set of eyes looking at the books. Set up Audit Committee Wagner - we have engaged fraud protection policy. Galligan - working on policy - fraud policy will be tied into the ethics policy.

Pendleton - Would like Matt to explain what are the plans. would like plan back to the council with finanical plan. Galligan - Mike Gantick, Clay and Fire Chief have been discussing. Savings of pre maintenance. there would be more cost avoidance. Would have to sit down with the Chief regarding other issues such as cleaning, etc. They are audited by our auditors. would like to sit with Chief, Gantick, etc. Really prefer to have discussions with the Chief and see what happens frm there. It is three buildngs that are town buildings that need to be maintained. the new building is more technical. Makes sense to make some of those changes. Cooney - we have started this process working with Clay and Mike with their ability with personnel. The concept was really to have - it was not to give up the bildngs and really just looked for guidance on the technical aspect of this. One key factor is staff. Taking on any kind of help would require the town t have more staff. we can work on those things and find a common goal. we were not looking to give up everythign, we were looking fo rtechnical advice. Delnicki - this is a reasonable approach. properly funded - part time maintenance. cost of adding a new person is a huge undertaking. part time to administer maintenance contracts. Wagner - are you on the same energy contracts as the town? Chief - they are separate at htis time. every year we evaluate the supplier. we switched from ATT to Cox. we are always looking to save money. Wagner - the town's conttact may be beneficial for the Fire Department. Ther emay be an opporutnity to do better. Anwar - what would be a reasonable time to report back to you. Galligan - June 1.
H. Discussion Item: Municipal Bench Marking: Technical Assistance Initiative (requested by Councilor Wagner)
Wagner - before energy committee was established. this involves putting data into database - tht would benchmark our use from year to year - they would provide free of charge and energy audit of one buildng of our choice. I was think Wapping School. we would decide down the road. theyw oudl help energy committee prpepare a strategic plan they call it a municipal action plan and again it does not cost anything other then investment of town staff time. they are proposing to provide interns over the summer to minimize impact on town staff. we get the audit of the buildng, municipalaction plan, tracking plan for neergyc use. Mr. Galligan will contact the BOE. If both sides willing, then we should do this. Galligan - the whole idea was to reduce energy costs - to set the baseline is key to tell us if we are going to meet our goals and objectives. Think we are at a point that the adut Anwar - is June 1st cutting it too close Galligna - if approve that night would have to turn around fast - would have paperwork done ahead of time. if you approve tonight would make is subject to the BOE approval. Anwar - would it benefit you to have resoution tonight - Galligan - could start working with people and could begin documents. Anwar - shoudl we explor adding this to the agenda

Pendleton - this is different then the Noise Ordinance. Michele will create ordinance - staff is requesting this. Galligan - some of th eissues that come up, P & Z could put H - have ordinance that has teeth - there have been time the Building Official has gon eout and shut construction down. Yagloff - construction ordinance have to make sure does not stop people from buildng a shet or deck - probably good idea to have separate construction ordinance. in your current ordinance. your current noise ordinance may be behind and are hving issues with enforecement so may want ot revise that ordinance. Delnicki - what development was causing all of the noise Pendleton - Delnicki - will this have impact on economic development? Galligan - in the industrial area unless it abuts residential area - where there is no residential could have leeway. Big companies but Delnicki - difference between an exisitn gcommercial 62 b - would like to take samplings. Yagaloff - some restrictions of hours - with decim Delnicki - CCM as a resource can they tell us what they are doing. Wagner - doucment in the package Pendleton - is working on something with construction ordinance Wagner - in summers workers want to get construction done early.- have to protect the homeowner projects. The actual noise ordinance deals with commercial and industrial. Galligan - need to keep homeowners exempt. in this instance you had a guy come in on Easter and do tree work. Very difficult to have work done on the weekends. Anwar - this is going to come back - will have better Jan -number of coplaints? Galligan - can ask the Chief snyder - we want to be business friendly community but want to make sure we are not strapping the hands of smaller businesses. hard to regulate construction. Do not like to govern for the exception.

Anwar - we have had an opportunity to look at draft. Councilor Wagner wanted to point out current issues with the draft. Wagner - one thing did was pulle dup the financial report of the town and the budget. there were a lot of inconsistencies with these things. Capital Projects Fund, - policy in the budget has capital stablization fund. The policy in the budget has items that we are not doing. 100% in favor of the idea to reduce to $25,000, setting goals - One of the areas talks about additions to grand list woudl these be new autos or structures? It also talks about fund balance in the Capital Projects. .Is that the fund balance that we are talking about because those funds are all committedd. Galligan - we are trying to draft a explained how the policy woudl work. If you have a project that is estimated at a certain amount - then the project does not cost that much, it would giv ethe committee the ability to use those funds towards another project. Capital STablization - the idea of hte ordinance - increase in new rvenues coming in a certain percentage woudl go towards the stabilzation fund- Wagner - why couldn't that be the unassigned portion of the capital projects? Galligna - you need a separate fund - it is not a true fund balance that you have. Yagaloff - concern about th echarter requires that capital outlays have to be encumbered. it is not clear tha tthe town has done tha talways. you have to continue to do projects. after three years the money lapses. you need to encumber thorugh capital projects fund. set policy in order ot use momey from the top of th eprioity list down. on the issue of additionas to grand list, Wgner - so someone put socmputers in their bildng, we need to decide if that is part of this Yagaloff - anything under grand list - taxable item. people respond better to capital improvmeents rather than capital projects. ou could encumber and could encumber your balance - Galligan - I don't think you would have separate colume - Wagner - if by some miricle - would show at th ebottom of the Yagaloff - needs to all be encumbered. If not encumbered will lapse. Galligan - required under state statutes to have a five year capital plan. you woudl adopt that plan and say here ar ethe projects you want to d over the fieve years. as long as you have approved capital projects plan - those funds wikll be committed but hav eto have five year plan. Wagner - understand plans change. Yagaloff - just do not want ot vilate the charter. moneh pu tint this account are for projects. Wagner - we have projects that we are going to go out and do right now. There are items on the list - Galligan - 5 year plan - took Wapping School - WAgner - can we put all the items together and work with one Galligan - you coudl work with the item from 2012. Wagner - ordinance and policy shoudl be consistent with eachother. Yagalof f- do the ordinance first - if you want to revise the policy need to put soe thought into it. Charter, ordinances and policies - most important is you hav eot make sure ou want ot do ordinance because this is a major endeavor. oridnance requires public heairng. Wagner - 5% or 10% that is given to the Caital Projects Yagaloff - first addition would come in for a one time event. Wgner - one ear get extra funds - put 10% of those funds bu thten the next year back to shere you are. Yagaloff - Galligan - if your budget has a steady capital budget - this will giv eyou additional funds. you ae cutting the capital budget al of the time - this will be a one time shot in the arm so you have a fund there so when you are in trouble you will have funds. you are trying otmake sure you get these projects done. Wagner - would like to see it keep going. - Anwar - this allows taht to happen - are you ok with the - Capital Yagalof f- Capital Improvement Fund Anwar - have to answer waht mill rate percentage will be used. Galligan - if you had $1M increase in rfvenue - percentage will go to Capital - rest into geenral fund. Riley - This year the capital project committee came forwad with 1.8 - budget approved for 1M - in theory I like the idea here but in practice it limits our flexibility. I think we do take all of the priorites inot consideration. This may reduce our financial ability. Have some concerns about ti. one thing not clear - these funds going above and beyond for waht we use towards capital project - are we going to end up with unencumbered? Galligan Riley - these are all encumbered - the encumbrances might change. Galligan - if the money is needed for an emergency, those projects could be changed by resoluion. Galligna - we are trying ot have fiscal stability - Riley - the 1% that would be required - concerned with grand list - the 1% Yagaloff - you coudl make adjustments - Riley - if we ar eputting i funds for next years project, Yagaloff - all designated for capital imkprovements. Riley -why would they all go right into production Yagaloff - Galligan - Delnicki - trying to figur eout what are mandates and what are guidelines. There are unintended consequences - you could find yourself in the problem to cover other times into the Delnicki - 5% of the capital - mandate? Yagaloff - yes Delnicki - offset would not be available - percentage to go to capital fund Yagaloff - you want the opportunity to go out to seveal projects. funds get redesignated to othe projects. Delnikci - good definition to Yagaloff - a good way to do this would be to have a policy that night - oridnance should be simple enough - it is goo complicated - in terms of definitions could agree on them that night. You are raising a lot of issues of definitions. Delnicki - I think we would want to stick with something that is straight forward and simple to administer and that is the 1% of the budget. See how that works - Anwar - I think we need to step back and understands - the things you are calling unintended consequences are actually intended consequences. there are a lot of projects that need to get done. This is a prevention strategy. this will protect projects. we need mechanism to protect infrastructures Mirek - this could require more cuts to the town budget and board budget. why parenthesis Yagaloff - these are different options. Mirek - additions to grand list that we should allocate 5-10% - to me that seems so f Yagaloff - Mirek - think it needs to be clear Yagaloff - Galligan - bluk of FedEx is personal property - Wagner - I think we have to recognize that 1% by itself is not enough to get items done. part of this is to build in an amount that is being allocated to capital projects. if there are opportunjityties taht investment saves funds, find way to work into capital projects. I don't think we are ready to send to public hearing. Would like to see more on this before public heairng. Riley - in theory klike the idea - practice - I am in favor of coming up with more discipline. We hve to keep it simple. Need to know what is in the grand list. The 1% straight forward. Debt SErvie I am dead set against. Caital markets change all of the time. Don't like what we may commit future Counjcils to. Paterna - I am going to take my lead from the Town Manager - do not think ready for a public hearing. Anwar - 25,000 limits - yes good idea 1% - good idea 5% property tax with specific definitiion - Galligan - there would have to be a guideline (what will make up that number) not including the retired debt(agreed should be removed)

Galligna - Review his Town Manager's Report - Turf field, Police Department Cell Tower, Microbrewery, - gave DOT traffic counts and feelt here is not enough traffic eto warrant a light there. Local company should not have to spend that type of money that DOT is responsible for. Showed DOT that there used to be a house there with a drivewya - would have access off of the driveway - had a great meeting with DOT. They do not hav ea problem with that, site difference is ok. parking behind the building - change driveway - Think that is the way we are going to go. P & Z has to do a review. Hopefully we can get microbrewery up and running. Think we worked that out an dhpe we can move forward Sullivan Avenue House - talked with Scannel Properties about coming up with the money - They are discusssing htis right now - Wayne Gerlt wil be informing me if this is a direction that they would like to go. Would like the Council's input on this project. Nevers Road Field - would like the Council's input on this issue. Avery heights Gas Service - Dzen Tree Farm Energy Commmittee - Riley - Meeting with the residents regarding the turf field. I think we heard them as a Council. The fact that we have not pt lights in there would be a negative impact on the amount of time the field could be used. would like to use non-toxic fill, address concerns with barriers. mvoing bleachers, trash are items that are easily accomplished as well as the use of the loud speaker. Is there a policy or practice regarding use by Youth Sports using BOE fields. Galligna - right now we don't have any policies. Would like to discuss with Superintendent to see if they have any policies or practice Ray - there are not policies at this time - we encourage no use before 11 - All of the fields at our schools they are relatively close to neighborhoods. Policy should govern all of BOE properties. We are not putting lights at the high school - the idea of eliminating use of field on Sundays would be a detriment and would not support. Paterna - do we have a confirmation that the bleachers will be moved. Galligna - will have my staff move those. Paterna - if you look at all of our facilities, no other school has fields tht close to neighborhoods. should show good faith effort that the neighbors concerns are met. should not discuss uses yet. Mirek - there could be an issue if we limit playing time there and not at other facilities. Should add field at Nevers so they can be used as practice fields. tht will give us higher quality fields. Avery Heights Gas Service - is there a time line established. Don't want the new pavement dug up Galligna - shoudl get small committee together. we can not get involved. if they are interested - we will coordinate with the companies. the problem is that it is nice ot have but there are costs assocaited with this. Up to the residents Mirek - in my neighborhood did it and - there was no chasrge. is there a way neighbors could be infomred Galligan - there is rep from Gas Company - they will come out and do promotions. Wagner - I would encourage you to go forward with teh cell tower. Sullivan House - I have never been inside, is it big enought for activities? Galigan - does not need to be massive - volunteers and other civic groups could use. Wagner - Chamber could fit in there and there could still be room for others? Galligna - yes and talked about refurbishing the garage. Delnicki - recollection when firs tput tower at PD - I think we dedicated most of the funds to the Police Department and Fire Department? Galligan - yes - renovation to communications. Delnici - it would make sense to follow tht same? Galligna - up to the Council. Delnicki - clarify, we are on the CCM contract fo renergy purchasing, is that all locations or actively metered? Delnicki - we should find out if other CCM members have done this way - Transcanada needs to stay competitive. Havens - recommendations are very good. the historic nature of the Clat House. Silo and Clat HOuse have to stay. Lets save the Clat House. Pendleton - thanks for the excellent report. appreciate town meeting with the neighbors near the high school. Better drainage which woudl be more of a financial savings. could use that to help the neighbors. No other school fields touch a neighborhood. there should be no Sunday play at th ehigh school. Will the tower have an effect if we went regional 911? Galligna - regionalization is Sharkey and Senator Lunney. It has nothing to do with SW. Anwar - Turf Field - we can divide into three categories, 1) 2) legality and 3) structural component - once sound barrier is good maybe the neighbors would be more receptive to Sunday play. Need to work closely with BOE. Cell Tower - $400,000 per year? Galligna - no one time cost. Anwar - if you recommend, I fully support. Microbrewery - moving in the right direction Sullivan Avenue House - would like to protect that asset. presently in working condition. would like to come up with strategy and partnerships. would b ea good way to preserve and create mechanism that hte taxpayers would not have to pay for it. Galligan - you may lose money on federal grants - house is old Anwar - Nevers Road field - neighbors have been vocal - glad that buisnesses are interested in supporting this. Barton property would provide much more and this should be discussed. Avery Heights - the reason part of the raods were ijmpacted was because of the - this is the time to put gas lines in. Energy Committee this proposal that Eversource has allows us to look at energy use of the town. The cost is free to the town. we have one of our schools tha twe want an energy audit of. the June 1st timeline is close - I was going to supest that we should add an agenda item to apply for the grant. If we coule add it would give us more time. This will benefit the town. Mirek - clarify that the Nevers Road field are separate from the Barton property. Kids at the High School would not be able to go to the Barton property. Riley - the original 11 acre project, how much did that property cost? Galligan - the whol Nevers Road was 3M - Riley - 11 acres we lease Galligna - yes we lease to a farmer. Riley - what do we get? Galligna - would have to look up - $1,000 or $1,500 Riley - I don't think the community is geting their bang for their buck. It is a prime location. The proposal that was put forth by the community is for using that property. I think it would be a perfect use. Good use for the community. Not right location to keep as a farm. Snyder - Looking for Council direction on Sullivan Avenue House and the Nevers Road field Galligan - also sale of cell tower Wagner - if we are going to take up Nevers Road field - would like review of legal basis when we bought this. People have come in and said that agricultural use not appropirate for that area. Galligna - will have TA review. Delnicki - eversource - TA look to see if we coudl get involved in any fashion, TM - etc. Where do we stand on this? Yagaloff - there is a 45 day appeal process - that is a decision the council has to make - 45 days from Siting Council. Time is runnin gout. If neighbors filed an appeal and they wanted the Town to participate - Galligan - the other thing I did meet with Marcia Wellman - told her the concerns. the are moving - ther eis not much from my standpoint - need to have better barriers. I drove p there and I know what the people are complaining about. I would like to have another meeting with the three neighbors that are directly affected. I can' do anything legally can only talk to them about public policy. we are going to try to have something done. they are moving some wires away from the houses. Delnikci - so it is work in progress and we are talking action. Delnicki - agree about the Clap House Paterna - Talked to some of the neighbors up there and through their hard work they are doing some things. they ar eputting sound pads under some towers bu tnot all. Right now the Siting Council ignors the towns - we need to find away to work together. Havens - Nevers Road property - went through that battles - the neighbors do not want ballfields there. The property where they live is absorbed with the Little League and nois ein the area - did not support then and do not support now. We don't want ot bring that problem back again. Pendleton - Would like Matt to explain what are the plans. would like plan back to the council with finanical plan. Galligan - Mike Gantick, Clay and Fire Chief have been discussing. Savings of pre maintenance. there would be more cost avoidance. Would have to sit down with the Chief regarding other issues such as cleaning, etc. They are audited by our auditors. would like to sit with Chief, Gantick, etc. Really prefer to have discussions with the Chief and see what happens frm there. It is three buildngs that are town buildings that need to be maintained. the new building is more technical. Makes sense to make some of those changes. Cooney - we have started this process working with Clay and Mike with their ability with personnel. The concept was really to have - it was not to give up the bildngs and really just looked for guidance on the technical aspect of this. One key factor is staff. Taking on any kind of help would require the town t have more staff. we can work on those things and find a common goal. we were not looking to give up everythign, we were looking fo rtechnical advice. Delnicki - this is a reasonable approach. properly funded - part time maintenance. cost of adding a new person is a huge undertaking. part time to administer maintenance contracts. Wagner - are you on the same energy contracts as the town? Chief - they are separate at htis time. every year we evaluate the supplier. we switched from ATT to Cox. we are always looking to save money. Wagner - the town's conttact may be beneficial for the Fire Department. Ther emay be an opporutnity to do better. Anwar - what would be a reasonable time to report back to you. Galligan - June 1.
H. Discussion Item: Municipal Bench Marking: Technical Assistance Initiative (requested by Councilor Wagner)
Wagner - before energy committee was established. this involves putting data into database - tht would benchmark our use from year to year - they would provide free of charge and energy audit of one buildng of our choice. I was think Wapping School. we would decide down the road. theyw oudl help energy committee prpepare a strategic plan they call it a municipal action plan and again it does not cost anything other then investment of town staff time. they are proposing to provide interns over the summer to minimize impact on town staff. we get the audit of the buildng, municipalaction plan, tracking plan for neergyc use. Mr. Galligan will contact the BOE. If both sides willing, then we should do this. Galligan - the whole idea was to reduce energy costs - to set the baseline is key to tell us if we are going to meet our goals and objectives. Think we are at a point that the adut Anwar - is June 1st cutting it too close Galligna - if approve that night would have to turn around fast - would have paperwork done ahead of time. if you approve tonight would make is subject to the BOE approval. Anwar - would it benefit you to have resoution tonight - Galligan - could start working with people and could begin documents. Anwar - shoudl we explor adding this to the agenda

Pendleton - this is different then the Noise Ordinance. Michele will create ordinance - staff is requesting this. Galligan - some of th eissues that come up, P & Z could put H - have ordinance that has teeth - there have been time the Building Official has gon eout and shut construction down. Yagloff - construction ordinance have to make sure does not stop people from buildng a shet or deck - probably good idea to have separate construction ordinance. in your current ordinance. your current noise ordinance may be behind and are hving issues with enforecement so may want ot revise that ordinance. Delnicki - what development was causing all of the noise Pendleton - Delnicki - will this have impact on economic development? Galligan - in the industrial area unless it abuts residential area - where there is no residential could have leeway. Big companies but Delnicki - difference between an exisitn gcommercial 62 b - would like to take samplings. Yagaloff - some restrictions of hours - with decim Delnicki - CCM as a resource can they tell us what they are doing. Wagner - doucment in the package Pendleton - is working on something with construction ordinance Wagner - in summers workers want to get construction done early.- have to protect the homeowner projects. The actual noise ordinance deals with commercial and industrial. Galligan - need to keep homeowners exempt. in this instance you had a guy come in on Easter and do tree work. Very difficult to have work done on the weekends. Anwar - this is going to come back - will have better Jan -number of coplaints? Galligan - can ask the Chief snyder - we want to be business friendly community but want to make sure we are not strapping the hands of smaller businesses. hard to regulate construction. Do not like to govern for the exception.

Anwar - we have had an opportunity to look at draft. Councilor Wagner wanted to point out current issues with the draft. Wagner - one thing did was pulle dup the financial report of the town and the budget. there were a lot of inconsistencies with these things. Capital Projects Fund, - policy in the budget has capital stablization fund. The policy in the budget has items that we are not doing. 100% in favor of the idea to reduce to $25,000, setting goals - One of the areas talks about additions to grand list woudl these be new autos or structures? It also talks about fund balance in the Capital Projects. .Is that the fund balance that we are talking about because those funds are all committedd. Galligan - we are trying to draft a explained how the policy woudl work. If you have a project that is estimated at a certain amount - then the project does not cost that much, it would giv ethe committee the ability to use those funds towards another project. Capital STablization - the idea of hte ordinance - increase in new rvenues coming in a certain percentage woudl go towards the stabilzation fund- Wagner - why couldn't that be the unassigned portion of the capital projects? Galligna - you need a separate fund - it is not a true fund balance that you have. Yagaloff - concern about th echarter requires that capital outlays have to be encumbered. it is not clear tha tthe town has done tha talways. you have to continue to do projects. after three years the money lapses. you need to encumber thorugh capital projects fund. set policy in order ot use momey from the top of th eprioity list down. on the issue of additionas to grand list, Wgner - so someone put socmputers in their bildng, we need to decide if that is part of this Yagaloff - anything under grand list - taxable item. people respond better to capital improvmeents rather than capital projects. ou could encumber and could encumber your balance - Galligan - I don't think you would have separate colume - Wagner - if by some miricle - would show at th ebottom of the Yagaloff - needs to all be encumbered. If not encumbered will lapse. Galligan - required under state statutes to have a five year capital plan. you woudl adopt that plan and say here ar ethe projects you want to d over the fieve years. as long as you have approved capital projects plan - those funds wikll be committed but hav eto have five year plan. Wagner - understand plans change. Yagaloff - just do not want ot vilate the charter. moneh pu tint this account are for projects. Wagner - we have projects that we are going to go out and do right now. There are items on the list - Galligan - 5 year plan - took Wapping School - WAgner - can we put all the items together and work with one Galligan - you coudl work with the item from 2012. Wagner - ordinance and policy shoudl be consistent with eachother. Yagalof f- do the ordinance first - if you want to revise the policy need to put soe thought into it. Charter, ordinances and policies - most important is you hav eot make sure ou want ot do ordinance because this is a major endeavor. oridnance requires public heairng. Wagner - 5% or 10% that is given to the Caital Projects Yagaloff - first addition would come in for a one time event. Wgner - one ear get extra funds - put 10% of those funds bu thten the next year back to shere you are. Yagaloff - Galligan - if your budget has a steady capital budget - this will giv eyou additional funds. you ae cutting the capital budget al of the time - this will be a one time shot in the arm so you have a fund there so when you are in trouble you will have funds. you are trying otmake sure you get these projects done. Wagner - would like to see it keep going. - Anwar - this allows taht to happen - are you ok with the - Capital Yagalof f- Capital Improvement Fund Anwar - have to answer waht mill rate percentage will be used. Galligan - if you had $1M increase in rfvenue - percentage will go to Capital - rest into geenral fund. Riley - This year the capital project committee came forwad with 1.8 - budget approved for 1M - in theory I like the idea here but in practice it limits our flexibility. I think we do take all of the priorites inot consideration. This may reduce our financial ability. Have some concerns about ti. one thing not clear - these funds going above and beyond for waht we use towards capital project - are we going to end up with unencumbered? Galligan Riley - these are all encumbered - the encumbrances might change. Galligan - if the money is needed for an emergency, those projects could be changed by resoluion. Galligna - we are trying ot have fiscal stability - Riley - the 1% that would be required - concerned with grand list - the 1% Yagaloff - you coudl make adjustments - Riley - if we ar eputting i funds for next years project, Yagaloff - all designated for capital imkprovements. Riley -why would they all go right into production Yagaloff - Galligan - Delnicki - trying to figur eout what are mandates and what are guidelines. There are unintended consequences - you could find yourself in the problem to cover other times into the Delnicki - 5% of the capital - mandate? Yagaloff - yes Delnicki - offset would not be available - percentage to go to capital fund Yagaloff - you want the opportunity to go out to seveal projects. funds get redesignated to othe projects. Delnikci - good definition to Yagaloff - a good way to do this would be to have a policy that night - oridnance should be simple enough - it is goo complicated - in terms of definitions could agree on them that night. You are raising a lot of issues of definitions. Delnicki - I think we would want to stick with something that is straight forward and simple to administer and that is the 1% of the budget. See how that works - Anwar - I think we need to step back and understands - the things you are calling unintended consequences are actually intended consequences. there are a lot of projects that need to get done. This is a prevention strategy. this will protect projects. we need mechanism to protect infrastructures Mirek - this could require more cuts to the town budget and board budget. why parenthesis Yagaloff - these are different options. Mirek - additions to grand list that we should allocate 5-10% - to me that seems so f Yagaloff - Mirek - think it needs to be clear Yagaloff - Galligan - bluk of FedEx is personal property - Wagner - I think we have to recognize that 1% by itself is not enough to get items done. part of this is to build in an amount that is being allocated to capital projects. if there are opportunjityties taht investment saves funds, find way to work into capital projects. I don't think we are ready to send to public hearing. Would like to see more on this before public heairng. Riley - in theory klike the idea - practice - I am in favor of coming up with more discipline. We hve to keep it simple. Need to know what is in the grand list. The 1% straight forward. Debt SErvie I am dead set against. Caital markets change all of the time. Don't like what we may commit future Counjcils to. Paterna - I am going to take my lead from the Town Manager - do not think ready for a public hearing. Anwar - 25,000 limits - yes good idea 1% - good idea 5% property tax with specific definitiion - Galligan - there would have to be a guideline (what will make up that number) not including the retired debt(agreed should be removed)
